Designbotic Tools for Revit
End-User License Agreement

This End-User License Agreement ("EULA") is a legally binding agreement between you, the Licensee (an individual customer or entity), and Designbotic sp. z o.o., a Polish company located at Armii Krajowej 116/20, 81-824 Sopot, Poland ("Designbotic", "we", "us", or "our").

This EULA governs your access to and use of our software products: Volumetrix for Revit, Terrain for Revit, and Sunlight Analyzer for Revit (collectively, the "Software" or "Tools"), which may include associated documentation and online services.

This EULA supplements our Terms of Service at designbotictools.com/terms-of-service. Business policies, billing, and account management are governed by the Terms of Service.

By installing, accessing, or using the Software, you agree to be bound by the terms of this EULA. If you do not agree to these terms, you may not download, install, or use the Software.

1. DEFINITIONS

"Account Manager" means the web-based platform hosted at account.designbotictools.com for managing licenses and user access.

"Admin User" means the primary account holder who purchases licenses and is responsible for inviting and managing other users.

"Autodesk Revit" means the building information modeling software developed by Autodesk, Inc.

"Free Trial" means the 4-week trial period during which users can access full Software functionality without payment.

"Invited User" means a user invited by an Admin User to access the Software under a multi-license arrangement.

"Personal Data" means any information relating to an identified or identifiable individual as defined by applicable data protection laws.

2. ELIGIBILITY AND AGE RESTRICTIONS

Minimum Age
The Software is intended for professional use by individuals aged 16 years or older. By accepting this EULA, you represent and warrant that you are at least 16 years of age. If you are under 16, you may not use the Software under any circumstances.

Geographic Availability
The Software is available for use worldwide, subject to applicable local laws and export regulations.

Professional Use
While the Software is designed for professional use with Autodesk Revit, both individual professionals and business entities may subscribe to and use the Tools.

3. SOFTWARE COMPATIBILITY AND SYSTEM REQUIREMENTS

Revit Compatibility
The Software supports Autodesk Revit versions 2023, 2024, 2025, and 2026. We maintain compatibility with the four most recent major Revit releases.

System Requirements
Users are responsible for ensuring their computer systems meet the minimum requirements for both Autodesk Revit and our Software Tools.

No Autodesk Integration
The Software operates as an independent add-on for Revit and does not communicate with Autodesk servers or require separate Autodesk licensing beyond your existing Revit license.

4. FREE TRIAL

Trial Period
We offer a 4-week free trial period for new users, providing full access to all Software features and functionality.

Trial Usage
During the free trial, you may use the Software on any of your projects without limitations, allowing you to fully evaluate its capabilities before purchasing a subscription.

Trial Registration
To access the free trial, you must provide a valid email address through our website at designbotictools.com. Email collection for trials is handled by Squarespace.

Conversion to Paid Subscription
At the end of your free trial period, you must purchase a subscription to continue using the Software. No automatic billing occurs at trial expiration.

5. LICENSING AND SUBSCRIPTIONS

License Grant
Subject to your compliance with this EULA, Designbotic grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software solely for your internal business or professional purposes.

Subscription Plans and Pricing
The Software is available under flexible subscription models, including monthly and annual plans. Current pricing for all Software Tools is available at designbotictools.com. Subscription rates may vary based on billing frequency and specific tool selection.

Pricing Changes
Pricing is subject to change for new subscriptions only. Existing subscribers will maintain their current pricing throughout their subscription term. For new pricing that affects renewals, we will provide at least 30 days advance notice.

Installation and Concurrent Use
You may install the Software on multiple computers but may only maintain one active login session at a time. Logging in on a new device will automatically log you out from other devices.

Multi-License System
Admin Users may purchase multiple licenses of the same Software tool and invite other users to access these licenses through the Account Manager platform.

6. MULTI-LICENSE ADMINISTRATION

Admin User Responsibilities
Admin Users who purchase multiple licenses are fully responsible for:

  • Managing invited users and their access permissions

  • Ensuring all invited users comply with this EULA

  • All actions taken by invited users under their licensed access

  • Payment and billing for all licenses under their account

Invited User Requirements
Invited users must:

  • Create their own account on account.designbotictools.com

  • Accept and comply with this EULA

  • Use the Software only as authorized by the Admin User

  • Maintain the confidentiality of their login credentials

License Sharing
Multiple users may share access to a single license, but only one concurrent login session per license is permitted.

7. PAYMENT AND BILLING

Payment Processing
Subscription payments are processed through Lemon Squeezy, our third-party payment processor. Alternative payment methods including direct invoicing are available upon request.

Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled. You may cancel your subscription at any time, with cancellation effective at the end of your current billing period.

Failed Payments
If payment fails, Lemon Squeezy will attempt to collect payment for 14 days with up to 4 automatic retries. During this period, your access continues. After all retry attempts fail, your subscription will be suspended until payment is resolved.

Direct Sales
For direct sales and invoice-based transactions, payment terms will be specified in your individual invoice. Standard payment terms are 30 days from invoice date unless otherwise specified.

8. REFUNDS AND CANCELLATIONS

No Refunds Policy
Due to the availability of our comprehensive 4-week free trial, all paid subscriptions are non-refundable. The free trial period allows you to fully evaluate the Software before making a financial commitment.

Limited Exceptions
Refunds may be considered only in cases of:

  • Billing errors resulting in incorrect charges

  • Technical impossibility where the Software cannot function on your system despite meeting stated requirements

Cancellation Process
You may cancel your subscription at any time through the Account Manager or by contacting our support team. Cancellation takes effect at the end of your current billing period, and you retain access until that date.

9. DATA COLLECTION AND PRIVACY

Data Collection
We collect and process the following Personal Data:

  • Email address, phone number, name, and surname

  • Company name and professional details

  • Login timestamps and session information

  • Autodesk Revit version information

  • Geographic location (country-level)

  • For direct sales: billing address, VAT numbers, and contact person details

Data Processing Purpose
Personal Data is collected and processed for:

  • Account creation and authentication

  • License management and billing

  • Technical support and customer service

  • Software compatibility and performance optimization

  • Legal compliance and business record-keeping

Privacy Policy
Detailed information about our data collection, processing, and protection practices is available in our Privacy Policy at designbotictools.com/privacy-policy, which forms an integral part of this EULA.

Data Retention
We retain your Personal Data for as long as your account remains active. Upon account deletion (requested by you), we will delete your Personal Data within 30 days of your request, subject to legal retention requirements.

10. THIRD-PARTY SERVICES

Service Providers
We use the following third-party services that may process your Personal Data:

  • Lemon Squeezy: Payment processing and subscription management

  • Squarespace: Website hosting and email collection for free trials

  • Google Firebase: User authentication, database services, and analytics

  • home.pl: Account Manager platform hosting

Data Processing Agreements
Our third-party service providers are bound by appropriate data processing agreements and privacy policies that comply with applicable data protection laws.

11. TECHNICAL SUPPORT

Support Availability
We provide technical support and usage guidance for all Software Tools through:

Response Time
We commit to responding to all support requests within 7 days of receipt. Support is provided in English and Polish.

Support Scope
Our support services include:

  • Technical troubleshooting and bug reports

  • Installation and configuration assistance

  • Usage guidance and best practices

  • Compatibility questions and system requirements

Equal Support
All subscription tiers receive the same level of technical support regardless of subscription price.

12. SERVICE LEVEL COMMITMENTS

Availability Guarantee
We strive to maintain 99.9% uptime for Software access and authentication services, calculated monthly excluding scheduled maintenance windows.

Performance Disclaimer
Software performance, including calculation accuracy and processing speed, is provided on a "best effort" basis. Users should always verify and validate calculation results before relying on them for professional decisions.

Service Remedies
If the Software experiences significant downtime due to issues within our control, affected users may request additional subscription days to compensate for lost access time.

Updates and Maintenance
We provide Software updates and maintenance on an as-needed basis, with a commitment to release at least one update annually for each Software Tool.

13. USER OBLIGATIONS AND RESTRICTIONS

Permitted Use
You may use the Software solely for legitimate professional purposes in connection with Autodesk Revit projects and workflows.

Prohibited Activities
You may not:

  • Use the Software for any illegal or unauthorized purposes

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code

  • Distribute, sublicense, rent, lease, or lend the Software to third parties

  • Remove or modify any proprietary notices or labels

  • Use the Software in ways that could damage, disable, or impair our services

  • Share login credentials with unauthorized users outside your licensed user count

Compliance with Laws
You are responsible for ensuring your use of the Software complies with all applicable local, national, and international laws and regulations.

14. INTELLECTUAL PROPERTY

Ownership
The Software, including all intellectual property rights, remains the exclusive property of Designbotic. This EULA grants you only the limited usage rights specified herein.

User Content
All results, analyses, reports, and projects created using the Software remain your exclusive property. We claim no rights to your work product or project data.

Feedback
Any feedback, suggestions, or improvements you provide regarding the Software may be used by Designbotic without restriction or compensation.

15. WARRANTIES AND DISCLAIMERS

Limited Warranty
We warrant that the Software will substantially perform in accordance with our published specifications during your subscription period.

Disclaimer
EXCEPT AS EXPRESSLY SET FORTH ABOVE, THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Professional Responsibility
You acknowledge that the Software is a tool to assist with professional workflows and that you remain fully responsible for validating results and ensuring they meet your professional standards and applicable regulations.

16. LIMITATION OF LIABILITY

Liability Cap
IN NO EVENT SHALL DESIGNBOTIC'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM.

Consequential Damages
DESIGNBOTIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Professional Liability
DESIGNBOTIC SHALL NOT BE LIABLE FOR ANY PROFESSIONAL DECISIONS, PROJECT OUTCOMES, OR CONSEQUENCES RESULTING FROM YOUR USE OF CALCULATION RESULTS OR SOFTWARE OUTPUTS.

17. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Designbotic from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Software, violation of this EULA, or infringement of any third-party rights.

18. TERMINATION

Termination by You
You may terminate this EULA at any time by cancelling your subscription and ceasing all use of the Software.

Termination by Designbotic
We may terminate this EULA immediately if you:

  • Breach any material terms of this Agreement

  • Fail to pay subscription fees after the grace period

  • Use the Software for illegal purposes

  • Violate our intellectual property rights

Effect of Termination
Upon termination, your right to use the Software ceases immediately. Sections relating to intellectual property, liability limitations, indemnification, and governing law survive termination.

19. GOVERNING LAW AND DISPUTE RESOLUTION

Governing Law
This EULA is governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.

Jurisdiction
Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts of Poland or, where applicable, competent courts within the European Union for cross-border disputes.

Consumer Rights
Nothing in this EULA affects any statutory rights that cannot be waived or limited by contract under applicable consumer protection laws.

20. GENERAL PROVISIONS

Entire Agreement
This EULA, together with our Privacy Policy and Terms of Service, constitutes the complete agreement between you and Designbotic regarding the Software and supersedes all prior agreements and understandings.

Modifications
We may modify this EULA from time to time. We will notify you of material changes via email or through the Software interface. Your continued use after notification constitutes acceptance of the modified terms.

Severability
If any provision of this EULA is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Assignment
You may not assign or transfer this EULA or any rights hereunder without our prior written consent. We may assign this EULA without restriction.

Force Majeure
Neither party shall be liable for any failure to perform due to causes beyond their reasonable control, including natural disasters, government actions, or internet service interruptions.
